Ideario educativo constitucional e interés del menor / Educational values in the Constitution and the best interest of the child

⟶ Resumen La tesis que sostenemos en este trabajo es que el ideario educativo constitucional vendría a identificase con el interés del menor, que está referido al libre desarrollo de la personalidad y se concreta en el ejercicio de los derechos fundamentales. La identificación del ideario constitucional con el interés del menor permite comprender mejor el papel que desempeña en el sistema educativo y que su transmisión, de forma transversal en las diferentes asignaturas o con una asignatura específica, no supone un menoscabo de la neutralidad del Estado y del pluralismo educativo. Así pues, el artículo 27.2 CE vendría a reconocer, junto con el ideario constitucional, el interés del menor, que sería el derecho a recibir una educación en los términos prescritos en él; es decir, una educación que permita el desarrollo de la personalidad en el marco del respeto a los principios democráticos de convivencia y a los derechos fundamentales ⟶ Palabras clave Ideario constitucional    Pluralismo educativo    Derecho a la educación    Interés del menor    Adoctrinamiento    ⟶ Abstract The thesis that we sustain in this work is that the constitutional educational values should be identified with the best interest of the child, which refers to the free development of the child´s personality and takes the form of the child´s exercise of fundamental rights. The identification of those constitutional values with the best interests of minors allows for a better understanding of the role those values play in the educational system and shows that the transmission of those values, in a cross-cutting manner in the different subjects or with a specific subject, does not imply an undermining of the neutrality of the State and the educational pluralism. Thus, Article 27.2 of the Spanish Constitution would come to recognise, together with the constitutional ideology, the best interests of the minor as they imply the right to receive an education in the terms prescribed therein; that is to say, an education that allows the development of the personality within the framework of respect for the democratic principles of coexistence and fundamental rights. ⟶ Keywords Constitutional values   Educational pluralism   Right to education   Best interest of the child principle   Indoctrination ⟶ Sumario 1.
